
Justin Batten, 29, was crossing Fifth Ave. at E. 97th St. when he was hit by the 2015 BMW, which was heading downtown, about 6:25 p.m. Wednesday.
A pedestrian crossing the street in East Harlem was fatally struck by a teenage BMW driver, police said Thursday.
Justin Batten, 29, was crossing Fifth Ave. at E. 97th St. when he was hit by the 2015 BMW, which was headed downtown, about 6:25 p.m. Wednesday.
Batten suffered severe head and body injuries. He was rushed by medics to New York-Presbyterian/Weill Cornell Medical Center but could not be saved.
Batten lived just a few blocks from where he was struck.
The 18-year-old BMW driver remained at the scene. He was questioned by cops and released without charges.
Speed does not appear to have been a factor but the incident is still being investigated, sources said.
